Entidade Reguladora para a Comunicação Social (ERC)

The ERC – The Regulatory Authority for the Media in Portugal – was created by Law 53/2005, of 8 November, having entered service with the inauguration of the Regulatory Board on 17 February 2006.

In order to achieve its primary objective – the regulation and supervision of all entities pursuing media activities in Portugal – the ERC was established as a legal entity under public law, endowed with administrative and financial autonomy and its own assets, with nature of an independent administrative entity.

The ERC’s main duties and responsibilities the regulation and supervision of the media. In performing its functions, the responsibility of the ERC to ensure respect for the rights and responsibilities constitutionally and legally enshrined, inter alia, freedom of the press, the right to information, independence from political and economic power and the clash of differing points of view, checking compliance with the standards for media and broadcast content and promoting the smooth and effective functioning of the market in which they operate. The ERC was therefore included as one of the guarantors of the respect and protection of the public, particularly the young and sensitive, rights, freedoms and guarantees and rigor, impartiality and transparency in the media area.
